Margin Owl LLC ("Margin Owl," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use our website, our contact and support channels, and our Shopify app, Margin Owl (collectively, the "Services").

This Privacy Policy applies to our website, our Shopify app, and any related contact, support, or help pages that link to or reference this Privacy Policy.

Role clarification. With respect to Merchant Data accessed through Shopify's APIs, Margin Owl acts as a data processor or service provider on behalf of the merchant. For information collected through our website, contact forms, and support channels, Margin Owl acts as the data controller or business responsible for that processing.

1. Information We Collect

A. Information You Provide Directly

We may collect information that you choose to provide directly to us, including:

  • your name
  • your email address
  • your store name or company name
  • the contents of messages, requests, or attachments you send to us
  • any other information you choose to provide when contacting us for support or other inquiries

B. Information We Receive from Shopify

When you install or use Margin Owl through Shopify, we receive certain store data made available through Shopify's APIs. We refer to this information in this Privacy Policy as "Merchant Data."

Merchant Data may include:

  • store identifiers, such as shop domain and related installation information
  • product and variant information
  • pricing and compare-at pricing
  • discount and promotion configurations
  • inventory information
  • store configuration information
  • app installation status
  • operational metadata reasonably necessary to provide, secure, and support the Services

Margin Owl collects only the Merchant Data reasonably necessary to provide and support the Services.

Margin Owl's core functionality does not require protected customer data such as customer names, email addresses, phone numbers, or postal addresses.

As of the Last updated date of this Privacy Policy, Margin Owl does not request or use protected customer data such as customer names, email addresses, phone numbers, or postal addresses in the ordinary operation of the app. Margin Owl also does not use order data unless and until such access is added, clearly disclosed, and reflected in an updated Privacy Policy.

C. Information We Collect Automatically

Website analytics and technical information

When you visit our website, we may automatically collect certain technical and usage information, including:

  • IP address
  • approximate geolocation derived from IP address
  • browser type and version
  • device type and operating system
  • referring pages and URLs
  • pages viewed and interactions on our website
  • session statistics
  • cookie and similar technology data

App logs, telemetry, and diagnostics

To operate, secure, troubleshoot, and improve Margin Owl, we may collect application and server-side usage data, such as:

  • sign-in and authentication events
  • report runs, audit runs, and status checks
  • timestamps and job status information
  • error logs and exception data
  • performance and diagnostic information
  • security and abuse-prevention logs

We use this information to understand service health, investigate issues, support merchants, and improve reliability.

D. Sensitive Personal Information

We do not intentionally collect or process sensitive personal information.

2. How We Use Information

We use information we collect to:

  • provide, operate, maintain, and support the Services
  • authenticate merchants and maintain app access
  • analyze pricing and promotion configurations and generate findings, alerts, and reports for a merchant's store
  • troubleshoot issues, monitor performance, detect errors, and improve reliability
  • secure the Services and prevent fraud, abuse, and unauthorized access
  • respond to support requests and other communications
  • comply with applicable law, enforce our agreements, and protect our rights

3. Shopify App Data Usage Commitments

With respect to Merchant Data obtained through Shopify:

  • We process Merchant Data solely as necessary to provide and support the Services for the merchant, in accordance with the merchant's instructions and our agreement with the merchant, and not for unrelated independent purposes.
  • We do not sell Merchant Data.
  • We do not use Merchant Data or customer data obtained through Shopify for competitive benchmarking.
  • We do not contact a merchant's customers using Shopify data unless the merchant separately authorizes that contact or the contact is otherwise permitted by applicable law.
  • We collect only the Merchant Data reasonably necessary to provide, secure, troubleshoot, and support the Services.
  • We do not use Merchant Data or data obtained through Shopify APIs, including derived or aggregated data, to create, train, fine-tune, or improve general-purpose artificial intelligence or machine learning systems, except as expressly permitted by Shopify's terms and applicable law. This does not prevent us from using Merchant Data solely to provide, secure, maintain, or improve merchant-specific features for the relevant merchant where permitted by Shopify's terms and applicable law.

4. Legal Bases for Processing

Where Margin Owl acts as a controller for personal information collected through our website, contact forms, and support channels, we rely on the following legal bases, where applicable:

  • To provide and operate our website, respond to inquiries, and deliver requested services — performance of a contract or steps taken at your request before entering into a contract
  • To respond to support requests and send service-related communications — performance of a contract and/or our legitimate interests in supporting and administering the Services
  • To secure, troubleshoot, monitor, prevent abuse, and improve the Services — our legitimate interests in operating a secure, reliable, and effective service
  • To use website analytics cookies and similar technologies, where consent is required — your consent
  • To comply with legal, tax, accounting, regulatory, or law-enforcement obligations — compliance with legal obligations

Where Margin Owl processes Merchant Data on behalf of a merchant through Shopify, the merchant is generally the controller of that data and Margin Owl processes it on the merchant's behalf in accordance with Shopify platform requirements and our agreement with the merchant.

5. Cookies, Analytics, and Similar Technologies

We may use cookies and similar technologies on our website for:

  • essential site functionality
  • security
  • analytics
  • performance measurement

We use Google Analytics on our website to help us understand website traffic and usage patterns.

We use Google Analytics in a limited, non-advertising configuration and do not use advertising features such as remarketing or cross-site tracking.

Where consent is required, we ask before using non-essential analytics cookies. On our website, we load Google Analytics and set associated analytics cookies only if you accept analytics through our cookie banner. If you reject analytics cookies, we do not load Google Analytics in that browser configuration.

The embedded Shopify app itself does not use non-essential cookies or client-side advertising trackers that we control. Within the app and related infrastructure, we primarily rely on server-side logs, diagnostics, and monitoring tools to operate, secure, and troubleshoot the Services, including for error reporting, performance monitoring, security, debugging, and troubleshooting.

We do not use our website or app for targeted advertising, remarketing, or cross-context behavioral advertising.

6. How We Disclose Information

We may disclose information to trusted service providers that process information on our behalf and under contractual restrictions, solely as necessary to operate and support the Services.

We maintain data processing agreements or similar contractual protections with our service providers that include obligations regarding data protection, confidentiality, and security, where appropriate.

Our current service providers may include:

  • Shopify — app platform and APIs
  • Google Analytics — website analytics
  • Fly.io — hosting and infrastructure
  • Neon — database services
  • Sentry — error monitoring
  • New Relic — performance monitoring
  • Microsoft 365 — email and support communications

We may also disclose information:

  • when required by law, subpoena, court order, or other lawful process
  • to protect the rights, property, or safety of Margin Owl, merchants, users, or others
  • in connection with a merger, financing, asset sale, acquisition, or similar business transaction
  • at your direction or with your authorization

We do not sell personal information, and we do not share personal information for targeted advertising or cross-context behavioral advertising.

7. International Transfers

We are based in the United States, and the Services are operated from the United States. Your information may be transferred to, stored in, and processed in the United States and other countries where our service providers operate.

Where required by applicable law, including the GDPR and UK GDPR, we rely on appropriate safeguards for international transfers, including the European Commission's Standard Contractual Clauses (SCCs) or other recognized transfer mechanisms where applicable.

8. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required by law or reasonably necessary for security, dispute resolution, or enforcement purposes.

Merchant Data

Unless a longer retention period is required by law or necessary for security or dispute resolution, we delete Merchant Data within 30 days after the earliest of the following:

  • the merchant uninstalls the app
  • the data is no longer required to provide the Services
  • we receive a valid deletion request from the merchant, a customer, or Shopify

Residual copies may remain in backup systems for a limited period and will be deleted or overwritten in the ordinary course.

We also respond to valid data deletion and access requests submitted through Shopify or applicable data protection authorities in accordance with our obligations under Shopify's platform requirements.

Where applicable, we also respond to Shopify's mandatory compliance webhooks and related privacy requests, including requests to provide customer data, redact customer data, or delete shop data, within the timeframes required by Shopify and applicable law unless we are legally required to retain certain information.

Support communications

We generally retain support communications for up to 24 months after the last interaction, unless a longer period is needed for an ongoing dispute, legal claim, fraud prevention, or other lawful purpose.

Security, diagnostic, and operational logs

We generally retain security, diagnostic, and operational logs for up to 12 months, unless a longer period is needed to investigate a security incident, abuse, fraud, or legal claim.

Website analytics data

Website analytics data is retained according to our configured analytics settings and provider tools, and not longer than reasonably necessary to understand site performance and usage trends.

9. Data Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect information under our control.

However, no method of transmission over the internet and no method of electronic storage is completely secure. As a result, we cannot guarantee absolute security.

10. Your Rights and Choices

Depending on your location and the nature of the information at issue, you may have rights to:

  • access personal information
  • correct inaccurate personal information
  • request deletion of personal information
  • restrict certain processing
  • object to processing based on legitimate interests
  • request portability of certain personal information
  • withdraw consent where processing is based on consent

Residents of certain US states may also have rights to know, access, correct, delete, and obtain a copy of personal information we process about them, subject to applicable exceptions under law.

We respond to valid data access, correction, and deletion requests in accordance with applicable data protection laws and Shopify platform requirements.

Where we rely on consent, you may withdraw it at any time by adjusting your browser or cookie settings, or by contacting us. Withdrawal does not affect the lawfulness of processing before withdrawal.

If you are in the EEA or UK, you also have the right to lodge a complaint with your local data protection authority.

We will respond to verified requests within the timeframe required by applicable law. For example, requests under the GDPR are generally handled within one month, and California requests are generally handled within 45 days, subject to lawful extensions.

If you are a merchant and want to delete your app account, you can uninstall the app from your Shopify admin. You may also contact us to request deletion of your data.

If a request relates to customer data controlled by a merchant, we may direct the requester to the relevant merchant, while assisting the merchant as required by applicable law or contract.

If we receive a privacy request through Shopify's compliance processes or from a merchant relating to Shopify-sourced data, we will handle that request in accordance with applicable law, Shopify platform requirements, and our role as a processor or service provider where applicable.

We may take reasonable steps to verify your identity before fulfilling a request.

11. Do Not Track Signals

We do not currently respond to browser Do Not Track signals.

12. Children's Privacy

The Services are not directed to individuals under 18, and we do not knowingly collect personal information from anyone under 18.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date above and may provide additional notice where appropriate.
